Conditions of use
1. Subject of regulation
1.1 These conditions of use regulate exclusively use of the websites of
the events run by Reed Exhibitions Deutschland GmbH, Völklinger Strasse
4, 40219 Düsseldorf, Germany. The conditions of use have no influence
on other contracts existing between Reed Exhibitions Deutschland GmbH
and exhibitors or other third parties, nor do they supplement them.
1.2 These conditions of use describe the requirements which need to be
fulfilled in order for contract partners of Reed Exhibitions Deutschland
GmbH to be allowed to use the websites of Reed Exhibitions Deutschland.
1.3 By using the websites of Reed Exhibitions Deutschland GmbH you are
acknowledging that the following points are binding.
2. Registration, password and security
2.1 When you register on a website that has been set up by Reed Exhibitions
Deutschland GmbH for an event being organised by Reed Exhibitions Deutschland
GmbH you must complete the full registration process and ensure that you
provide current, complete and correct details.
2.2 Choose a password and a user name. You are fully responsible for ensuring
that your password and user name are not disclosed. You are responsible
for all activities associated with your registration. You are obliged
to inform Reed Exhibitions Deutschland GmbH immediately of any unauthorised
use of your account and any other contravention of the security regulations.
You may not use the accounts of third parties without the prior consent
of the relevant account owner. With some Reed Exhibitions Deutschland
GmbH sites you will automatically be given a Reed Exhibitions Deutschland
GmbH password account.
3. Links to websites of other suppliers
3.1 Some Reed Exhibitions Deutschland GmbH sites contains links to other
suppliers' websites and, in some instances, websites are also integrated
into the Reed Exhibitions Deutschland GmbH sites by other means (referred
to in general as "linked websites"). Some of the linked websites are not
under the control of Reed Exhibitions Deutschland GmbH and Reed Exhibitions
Deutschland GmbH is not responsible for the content, in particular links,
updates and products, or functional carriers of the linked websites. Reed
Exhibitions Deutschland GmbH provides these links simply as a service
or purely for information purposes. This in no way constitutes endorsement
of the website by Reed Exhibitions Deutschland GmbH or indicates any connection
to its operators.
3.2 Any transactions conducted with third party suppliers whom you access
via the Reed Exhibitions Deutschland GmbH sites and services are concluded
exclusively between you and the respective third parties. Reed Exhibitions
Deutschland GmbH is neither a representative, subcontractor or vicarious
agent of this third party. Any claims arising on your part are to be directed
straight to the third parties.
4. Obligations concerning conduct
4.1 The Reed Exhibitions Deutschland GmbH site and services may
not be used for purposes that are contrary to the law or other regulations,
or which would breach these conditions. The websites and web services
of Reed Exhibitions Deutschland GmbH – and the associated networks – may
not be damaged, deactivated, overloaded or otherwise adversely affected.
4.2 Furthermore, you undertake to ensure that the use of the Reed Exhibitions
Deutschland GmbH sites and services is not adversely affected by third
parties. You are not to attempt by cracking codes, illegally obtaining
passwords or by any other method to gain unauthorised access to the Reed
Exhibitions Deutschland GmbH sites or services, other users' accounts,
computer systems or the networks associated with them. You may not make
attempts to obtain materials or information from the websites and web
services of Reed Exhibitions Deutschland GmbH via means other than those
incorporated in the websites and web services of Reed Exhibitions Deutschland
GmbH themselves.
5. Use of services
5.1 The Reed Exhibitions Deutschland GmbH sites and services may include
email services, bulletin board services, chat rooms, newsgroups, fora,
communities, personal websites, calendars, photo albums, batch orders
and/or other messaging or communications facilities for communicating
with other users ("communication services"). You declare that you agree
to use the communication services only for the preparation, sending and
receiving of messages and corresponding material, which relate to the
respective communication service.
5.2 With regard to the use of the communication services, you may not
use the communication services in connection with surveys, competitions,
chain letters, junk emails, mass advertising or all other unwanted messages
of a commercial or any other nature.
5.3 You also undertake to do the following:
- You may not libel, pester or threaten other people or infringe their legal rights (such as rights to privacy and protection of their person) in any other way. You may not publish, prepare, upload, send out or distribute any inappropriate, libellous, obscene, immoral or illegal material or information.
- You may not publish, prepare, upload, send out or distribute or in any way use anything that contains pictures, photographs, software or other material, the use of which would infringe the rights of third parties (in particular copyright and performing rights).
- You may not upload any damaged files or files containing viruses, Trojan horses, worms, "time bombs" or "cancelbots" or upload comparable programs or software that damage or that could damage other computer systems.
- You may not falsify or delete from an uploaded file any author's comments,
legal or other notices and/or means of identification of ownership or
notices concerning the origin or the source of software or of other material.
You shall not prevent any users from using the communication services, or restrict their use. - You may not breach any rules of conduct or guidelines that apply for a specific communication service.
- You may not infringe any applicable laws or legal provisions.
- You may not use a false identity for the purpose of misleading others.
- You may not use, download or provide to another natural or legal person who is not a member of a Reed Exhibitions Deutschland GmbH site or service any lists of members of Reed Exhibitions Deutschland GmbH sites and services or other user or usage information or part of such, whether for payment or not.
5.5 The material that is uploaded to a communication service can be subject to certain restrictions concerning usage, duplication and/or distribution. You alone are responsible for ensuring that these restrictions are complied with if you download this material.
6. Content from users
6.1 Reed Exhibitions Deutschland GmbH makes no claims concerning
any material that you make available to the public on Reed Exhibitions
Deutschland GmbH sites (including feedback and suggestions) and/or on
any websites and services of Reed Exhibitions Deutschland GmbH that you
prepare or make available as an upload, entry or transmission for the
general public or for a private community. Reed Exhibitions Deutschland
GmbH is however entitled to remove this material at any time if there
are grounds to suspect that it is being used contrary to legal provisions
or these conditions of use.
6.2 You may only publish, upload or transmit content for which you have
the required rights (in particular performing rights, proprietary rights
and/or copyright). If you provide content within the framework of a communication
service then you are granting permission to (a) all members of the communication
service (for all content accessible by a member), and/or (b) the general
public (in so far as this is accessible to the public) to use your content
within the context of the Reed Exhibitions Deutschland GmbH site and services,
in accordance with the provisions for use of the site (including, but
not limited to, for example, the production of copies and derived works).
This includes with no restrictions upon it a non-exclusive, worldwide,
free of charge licence to copy, send out, transfer, publish, cite, duplicate,
process, translate and reformat your content, without your name being
added to this content, and it also includes the right to sublicence such
rights to suppliers of Reed Exhibitions Deutschland GmbH. The licences
granted in relation to content as mentioned above end at the time when
you completely remove this content from the Reed Exhibitions Deutschland
GmbH site. This condition does not affect licences already granted for
such content before complete removal. No fees are payable for the use
of your content. This clause only applies for content that is legal and
the publication and/or use of which does not infringe the law of the Federal
Republic of Germany.
7. Liability disclaimer
7.1 The information, software, products and services of the Reed
Exhibitions Deutschland GmbH sites and services may contain inaccuracies
or typographical errors. The Reed Exhibitions Deutschland GmbH sites and
services and the information contained in them will be changed regularly.
Reed Exhibitions Deutschland GmbH and/or their respective suppliers reserve
the right to make improvements and/or changes to the Reed Exhibitions
Deutschland GmbH sites and services at any time. Advice which you obtain
via the Reed Exhibitions Deutschland GmbH sites and services may not be
used as the basis for making personal, medical, legal or financial decisions.
In such cases the opinion of an expert should always be obtained.
7.2 Reed Exhibitions Deutschland GmbH is not liable for content and activities
originating from users. These may not be attributed to Reed Exhibitions
Deutschland GmbH; nor do they represent the views and opinions of Reed
Exhibitions Deutschland GmbH. The content also includes links placed by
users on websites within Reed Exhibitions Deutschland GmbH's sites and
services.
7.3 In addition, Exhibit & More AG is only liable in so far as Reed Exhibitions
Deutschland GmbH and/or their support staff and legal representatives
may be charged with deliberate misconduct or gross negligence. Liability
for slight negligence is only accepted in cases where fundamental contractual
obligations are infringed or if promised characteristics are missing.
7.4 In the case of slight negligence, all liability of Reed Exhibitions
Deutschland GmbH and/or its subcontractors, support staff and representatives
is excluded for indirect damage, especially secondary damage, unforeseeable
damage, atypical damage or lost profits. Reed Exhibitions Deutschland
GmbH is furthermore not liable for official procedures implemented by
the authorities, labour disputes, incidental losses and force majeure
for which it carries no responsibility.
7.5 Users' damage claims in the case of slight negligence on the part
of Reed Exhibitions Deutschland GmbH are limited to a maximum of € 500.00.
8. Claims for compensation and for omission
8.1 Exhibit & More AG is entitled but not obliged, if their services
are used contrary to the law in accordance with Section 6 of these conditions
of use, to take appropriate measures against the party having caused the
problem at the cost of this party, in order to eliminate any legal breach
or infringement of their services or any problems to users of the sites
of Reed Exhibitions Deutschland GmbH in the future.
8.2 The costs incurred by Reed Exhibitions Deutschland GmbH in so doing
are to be met by the party having caused the problem.
9. Choice of law / Place of jurisdiction
9.1 The law of the Federal Republic of Germany applies exclusively;
the UN CISG is excluded.
9.2 It is agreed that the place of jurisdiction for any disputes arising
from the use of the Reed Exhibitions Deutschland GmbH websites will be
Düsseldorf in the Federal Republic of Germany.
10. Severability clause
Should individual provisions of these Conditions of Use prove
invalid, in full or in part, or become so in the future, this shall not
affect the validity of the remaining provisions. The provision which is
invalid, in full or in part, shall be replaced with a valid provision
which most closely reflects its commercial intention and purpose. All
agreements, individual approvals and special regulations require written
confirmation by Reed Exhibitions Deutschland GmbH. This applies in particular
for deviations from these Conditions of Use.
